If your employer fully support you on your entry into USA after long stay in India, you are good.
You may need to show documents, letter from employer, and also he will be ready to answer phone upon entry. (they may ask him whether a job is available for you).
You can enter before your visa expiry.
Talk with company lawyer.

Each month, annual preferences and foreign state limitations are subdivided by the Visa Office into monthly portions based on the applicants reported at consular posts and CIS Offices. If there is a sufficient amount of visas in a category to supply the demand then that category is considered �current� but when the demand over-exceeds the allotted supply of visas the category is considered �oversubscribed.� This is when a visa cut-off date is established, the cut-off date is the �priority date of the first documentarily qualified applicant would could not be accommodated for a visa number.�

Hi,
My Perm LC is applied in DEC 2007, GOT AUDIT RFE last week.
I am really worried about RFE. My Employer advised me we need reply them quickly in 1 week so that they feel we are serious.
Mine is BE+5years, applied under EB2 CATEGORY. I have 9+years of experience.
My employer advised me create a document which explains the Job Duties and responsibilites etc project by project.
and documnets including resume, experience letters, etc.
Can any body explain me what exactly uscis is expecting from me , what kind documents/avidence they are expecting in RFE ?
RFE Reason says:
Please provide documents such as position descriptions, the percentage of time spent on the various duties, organizational charts, and payroll records demonstarting that the qualifying experience gained by the alien while working for the employer, including as a contract employee, was ina position not substantially, i.e., not requiring performance of the same job duties more than 50 percent of the time to the position for which certification is being sought, and/or documents demonstarting that it is no longer feasible to train a worker to qualify for the position.

I am a resident physician on h1b visa which is expiring on 6-30-2010 . I am in process of applying for H1B extension for my fellowship. My wife is on H4 visa (expiring in 3-20-2013 since she got 5 yr multiple visa). Recently she visited Kuwait and on her re-entry she was given entry (on her I94) up to 3-15-2013 (up to 5 days prior to her visa expiration). Will she also need extension in this case along with my extension or can she stay in US till 2013 with out extension Thanks.

His wife's GC is through his and her stay here depends on him.
So don't go for the route, to file for him as her depenant. This will make everything screwup.
Many people entered after their GC approval.
u cannot use Canada PR to enter US. If he left US without AP then his application for adjustment of status is considered abandoned.
spouse can file new application in dependent category. the dates for dependent category have come quite close since last 6 months. he could expect a GC in 6 months !

I dont mind the main font, the ammount one is cool. I think you need to find some way to make the contrast beter towards the right side of the main text, amybe with a different fill or a stroke. I like it!

Provided that the H-1B extension was filed before the prior H-1B status expired, you can stay in the US and work for that employer while the extension is pending.

Bush said he wants to improve the working visas, I think the prority needs to offer to Canadians because Canadinas use the same language and education system, the distance is closer. We need to call all the senetors, the working visas.etc. need to go to Canadina citizens first.
I agree. For the genero city of canedians for using the same langwage, the goverment also pay for at least one ice hoky rink in every city. But what about the French canadians.. they should instead be called freedom canadians and directly get a green card...

Good evening,
I am currently in the United States and in the process of changing my Q1 into a F1 visa.
My contract with the Q1 visa unexpedently ended in June 2009 and the visa was expiring on the 17th of september 2009.
I sent the file with all the papers to the USCIS before the end of the expiration date and is still in process at this time.
I heard that i can not exceed the period of 180 days after my last day of work with my Q1 Visa.. Is this true ?
I was thinking by the time i filed everything before the end of my Q1 visa, i could stay in the United States until the approval or denial of my F1 visa...
if this is true :
1. Do I have to wait in France for the answer of the USCIS, or my case will be cancelled and I have to start all oveer again in France ?
2. If I do not stay more than 180 days, going back to France and coming back for exemple 1 week after to the US with a tourist visa, am I able to change my status to F-1 ?
3. If i receive an approval answer from USCIS after a few days that I've been back in France, will it be valid ? Can it be sent to me ?
4. Do I have to get a new I-20 from the university if I am starting the process in France, or the one that I have is still valid ?

Me and my husband(primary applicant) filed our I 485, I 765, and I 131. Recieved by USCIS on 06/29/2007. our lawyer recently got our reciept nos. my husband got a notice saying FP fee rejected and has been asked to re submit the fee,when, in fact all our checks have already been cashed.all of my notices say case recieved and pending.my question is ,with my husband's case in suspense, will my application be also with held or will USCIS go ahead with my application. I am the dependant spouse in this case. please respond. Thank you.

My wife is a Canadian citizen, what is the process of getting a H4 for her? (I am on an H1-140 approved).
1)Do I file an app with USCIS?
2)Can she go apply at the US consulate in Canada?
What type of documents, forms are involved ?
